Check one thing honestly before filing: is it a copy, or just a similar product? Copyright protects your specific expression, not the idea of a budget planner or a minimalist style. A notice against a seller who simply made something similar is likely to fail and may expose you to liability, because the DMCA penalizes knowing misrepresentations.
The DMCA notice template, element by element
The U.S. Copyright Office summarizes the six elements a notice under 17 U.S.C. 512(c)(3) must contain, in its Section 512 resources and its sample notice. Platforms build their forms around these, so knowing them means you fill any form correctly.

Send email notices to the platform's designated DMCA agent. Service providers list their agents in the Copyright Office's DMCA designated agent directory, which you can search by company name.
How to file a DMCA against an Etsy listing

Sign in with your shop account if you are reporting your own work. Choose who owns the rights. Expected result: a portal account linked to you as owner.
- 2Add your intellectual property
Describe the copyrighted work. If you report for an employer or client, upload a letter of authorization when asked.

On the Reports tab choose Get started or Create a report, pick the owner and Begin report.
- 4Add the listings
Search Etsy inside the portal, or choose Upload multiple listings and paste listing IDs or URLs.
- 5Review and submit
Check every element is filled. Expected result: an email confirmation, then an email with the outcome.
Etsy's help page also notes the portal is in US English only but usable anywhere, and that you can first try to reach an agreement with the seller. A short, factual message sometimes resolves it faster than a report, but do not wait on a reply that never comes.
Making your evidence easy to act on
Reviewers at any platform process many reports, and a clear report gets a clean decision. Write the description field as if the reader has never seen either listing. Name the work, state when you first published it, and say exactly what was copied: the full file, the cover design, the illustrations, the page layouts or the listing photos. If only part of a bundle was copied, say which pages.
- Lead with the strongest proof. A side-by-side image of your page and theirs beats a paragraph of explanation.
- Point to your original listing. Its publish date and reviews show you were selling first.
- Keep the tone factual. Accusations about the seller's character add nothing; the copied material is what matters.
- Report each copy once. Duplicate reports for the same listing slow things down rather than speeding them up.
- Log everything. Keep a simple record of each report: date, platform, listings, outcome. If the same seller copies you again, that history helps.
If a report is rejected, read the reason before refiling. Most rejections come from missing listing URLs, a work description that does not match what is in the listing, or a claim about a general idea rather than copied material. Fix the specific gap and submit again.
DMCA takedown on Temu and other marketplaces
Temu's intellectual property policy requires rights owners or authorized agents to log in to its IP Portal and include identification of the work, the nature of the infringement (product, packaging, product page image or text), the product URLs, the infringing parties, supporting documents and contact details, with reports made in good faith under penalty of perjury (checked October 2026). It has a separate section for copyright notices under the DMCA.
For any other marketplace, look for an IP or copyright reporting form in its help center first; if there is none, email the designated agent from the Copyright Office directory using the template above. The six elements stay the same everywhere a US platform is involved.
The counter-notice reality
A counter-notice is the other seller's formal claim that the removal was a mistake or misidentification. The statute's elements include their signature, identification of the removed material, a statement under penalty of perjury, their name, address and phone number, and consent to a federal court's jurisdiction.

Many copycat sellers never counter-file, because it means giving their real name and address and accepting a court's jurisdiction. When one does, decide calmly. A lawsuit is expensive and slow. The U.S. Copyright Office's Copyright Basics circular explains that registration is needed for works of U.S. origin before an infringement suit can be filed, and that timely registration affects the damages available. Reduce the next copy
- Watermark previews, not the purchased file, so listing images are less useful to thieves.
- Keep dated source files and export logs; they are your proof of authorship.
